Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Home of IQ. They govern your use of the Home of IQ website, IQ test, and training platform (together, the "Service"). By taking the test, creating an account, or subscribing, you agree to these Terms. Please read Section 13 (Arbitration; Class-Action Waiver) carefully — it affects your legal rights, including how disputes are resolved. If you do not agree to these Terms, do not use the Service.

Provider. The Service is provided by CLIQstream B.V., a private limited company organised under the laws of the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 94411867, with its registered office at Stadhouderskade 85, 1073AT Amsterdam, Netherlands. Contact: support@homeofiq.com.

Where we operate. The Service is offered internationally. Payments are processed by our merchant of record, Paddle, which charges any applicable VAT or sales tax based on your location.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under the laws of your state of residence to use the Service or purchase a subscription. By using the Service you confirm you meet these requirements. The Service is not directed at children.

2. The Service

Home of IQ provides an online cognitive assessment of 35 questions across four domains (logical, numerical, verbal, and spatial reasoning), a personal results report with an estimated IQ score and percentile, a shareable certificate, and ongoing brain-training exercises.

Educational and entertainment purposes only. Your results are estimates produced by an automated scoring model and are intended for educational and entertainment purposes only. They are not a professional, clinical, diagnostic, or psychometric evaluation; they are not administered under standardized testing conditions; and they must not be relied upon for any medical, educational, employment, credit, insurance, housing, or legal decision. If you need a clinically valid assessment, consult a licensed psychologist.

3. Accounts

Accounts are created through the test → purchase flow. You are responsible for the accuracy of the information you provide, including the email address your report is delivered to, and for keeping your credentials secure. Accounts are personal: one account per person, and you may not share access or transfer your account. We may suspend or terminate accounts involved in fraud, abuse, or violation of these Terms.

4. Subscription, billing, and automatic renewal

Access to your full results and the training platform requires a paid subscription of $12.95 per month, plus applicable taxes. The price shown at checkout is the price you pay — no setup fees, no trial conversions, no hidden charges. We may change prices on future renewal cycles with at least 30 days' advance notice by email.

Automatic renewal — please read. Your subscription renews automatically for successive one-month terms at the then-current price. Your payment method (which you authorize us to charge through our payment processor) will be charged at the start of each renewal term until you cancel. By subscribing, you expressly authorize these recurring charges. You can review your renewal date in Account › Membership. Payments are processed by our merchant of record, Paddle, which appears on your statement as the seller of record and handles applicable taxes.

How to cancel. You can cancel your subscription at any time, by any of the following equally simple methods:

• from within the Service, in Account › Membership, in one click; or
• by emailing support@homeofiq.com from your account email address.

Cancellation takes effect at the end of your then-current billing period; you keep access until then and are not charged again. We do not require phone calls, "save offers," or retention surveys to cancel. This cancellation method is no more burdensome than the method used to subscribe, consistent with the FTC's Negative Option / "Click-to-Cancel" Rule.

Optional one-time purchases.From time to time we may offer optional one-time purchases inside the Service — for example, a retest unlock ($0.99) that lets a member skip the cooldown between IQ retests. These are charged once at the time of purchase, are non-refundable, and the benefit is delivered immediately. By completing checkout you expressly request immediate supply of the digital benefit and acknowledge that you may lose any statutory right of withdrawal under Article 16(m) of the EU Consumer Rights Directive.

Refunds. Refunds are handled under our Refund Policy, which is incorporated into these Terms by reference.

Payment processing. Payments are processed by an independent third-party payment provider. We do not store your full card details. By providing payment information you represent that you are authorized to use it.

5. Intellectual property; license to use the Service

The Service — including the test questions, scoring model, training content, certificates, branding, designs, and software — is owned by or licensed to Home of IQ and is protected by U.S. and international copyright, trademark, and other intellectual- property laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own non-commercial use while your subscription is active.

You may share your own certificate and results. You may not copy, resell, redistribute, scrape, reverse-engineer, frame, mirror, decompile, or otherwise extract test content, scoring outputs, or training materials; use the Service to build a competing product or service; or use any portion of the Service to train machine-learning or generative-AI models.

6. Acceptable use

You agree not to: (a) interfere with or disrupt the Service or the servers and networks supporting it; (b) attempt to access another user's account or data; (c) use automated tools, bots, headless browsers, scrapers, or extensions to take the test, view content, or retrieve data; (d) circumvent rate limits, access controls, or security features; (e) misrepresent your results as a clinical or professional evaluation; (f) use the Service for any illegal, infringing, abusive, harassing, or fraudulent purpose; or (g) submit false or misleading information.

7. Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without compensation or attribution.

8. Third-party services

The Service relies on third-party providers, and the brain-training exercises may be powered by a third-party provider (CogniFit). Their own terms and privacy policies may apply to the portions of the Service they provide. We are not responsible for the conduct of third-party services or content.

9. Disclaimers

THE SERVICE AND ALL CONTENT, RESULTS, AND TRAINING ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SCORES OR RESULTS WILL BE ACCURATE OR RELIABLE. RESULTS ARE ESTIMATES FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES AND ARE NOT A CLINICAL DIAGNOSIS. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOME OF IQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Home of IQ and its officers, directors, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service in violation of these Terms or applicable law, (b) your content or submissions, or (c) your infringement of any third-party right. We may assume exclusive control of the defense, and you agree to cooperate.

12. Termination

You may stop using the Service at any time and cancel your subscription as described above. We may suspend or terminate your access immediately and without prior notice if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk to us, the Service, or other users. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and miscellaneous) survive termination.

13. Dispute resolution

Informal resolution first. Before filing any formal claim, you agree to contact us at support@homeofiq.com with a written description of the dispute and your contact information, and to give us 30 days to attempt to resolve it informally.

EU online dispute resolution.If you are an EU consumer and we cannot resolve your complaint, you may submit it to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer dispute settlement entity.

14. Governing law; venue

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. If you are a consumer resident in the European Union, you also benefit from the mandatory protections of the consumer law of the country in which you live; this clause does not deprive you of those rights.

Any disputes arising out of or relating to these Terms will be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, unless mandatory law requires that the dispute be brought before another court.

15. Changes to the Service or these Terms

We may update the Service and these Terms over time. If we make material changes, we will notify you by email or in the product before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, cancel your subscription before the changes apply.

16. Notices

We may send you legal notices by email to the address on your account, by posting them in the Service, or by other reasonable means. You agree that electronic notices are sufficient and satisfy any legal requirement that notice be in writing. You may send legal notices to us at support@homeofiq.com with a copy to CLIQstream B.V., Stadhouderskade 85, 1073AT Amsterdam, Netherlands.

17. DMCA copyright notices

If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to legal@homeofiq.com, including: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the allegedly infringing material and its location; (iv) your contact information; (v) a good-faith statement that the use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf.

18. Miscellaneous

These Terms (together with the Privacy Policy and Refund Policy) are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, financing, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). There are no third-party beneficiaries.
